These terms apply to businesses (restaurants, cafés, bars, bakeries, pubs and similar) that apply for, try or subscribe to an Echivo business plan and manage a venue and offers in the Echivo dashboard. By starting a trial or using the dashboard you accept them on behalf of your business.
1. Who we are
Echivo is operated by Liviu-Casian Sime, a natural person (individual) based in Oradea, Romania, founder of Echivo — until a PFA (authorised sole trader) or company is registered. Contact: casisime@gmail.com. Postal address: [FOUNDER: postal address]. Legal entity (once registered): [FOUNDER: PFA/company name, registered office, CUI, Trade Register no.]. Contact: casisime@gmail.com, +40 748 577 592.
Paid plans are sold and invoiced only by the PFA or company named above, once it is registered. Until then Echivo offers only free listings and free trials and accepts no money of any kind.
These terms are business-to-business: the 14-day consumer right of withdrawal does not apply. Consumer protection rules for app users are not affected.
2. The service
Echivo is a city guide app. Businesses can have a venue profile (information, photos, opening hours) and publish discounts and offers for everyone or for specific groups (for example students, association members, medical staff, teachers, seniors). Depending on the plan, businesses can run promotions, see statistics and be featured near monuments.
The Echivo app is in early access. We aim for the service to be available continuously but do not guarantee uninterrupted availability, a minimum number of users, views or redemptions.
3. Plans, free trial and prices
The available plans, their features, limits and prices are shown on echivo.com/horeca and in the dashboard at the time you choose them. A free plan is available.
New businesses can request a free trial of 30 days of a paid plan. No payment details are required for the trial.
When the trial ends and no paid plan has been agreed, the account automatically moves to the free plan. Your data is kept; features and offers beyond the free plan’s limits are paused, not deleted.
Prices are in euro per month. Whether VAT applies and the invoicing entity will be stated on the invoice.
We may change plans and prices for the future with at least 30 days’ notice by email; a change never applies to a period already paid.
4. Billing during early access
During early access, billing is manual, by bank transfer against an invoice (issued electronically through e-Factura as Romanian law requires). We do not collect card details. Upgrades are requested in the dashboard and confirmed by us by email.
A paid plan starts only once the PFA/company named in section 1 exists and you have confirmed the upgrade. Fees become payable after you receive its invoice, with the payment details and due date shown on it.
If annual plans are offered, the first annual term can be cancelled within 14 days of payment for a full refund.
If an invoice is not paid within 14 days of its due date we may move the account to the free plan after a reminder.
5. Cancellation and termination
You can cancel a paid plan or the trial at any time by email or from the dashboard. A paid plan stays active until the end of the period already paid, then moves to the free plan. Paid periods are not refunded unless the law requires it.
You can ask us to close the business account and remove the venue listing at any time.
We may suspend or remove offers, a listing or an account that breaks these terms, after notice where reasonably possible, or immediately for serious breaches (for example misleading offers, illegal content, abuse of the platform).
6. Your content and offers
You are responsible for everything you publish: venue information, photos, prices, offers, conditions and schedules. It must be true, up to date and lawful.
Offers must state the real conditions (who qualifies, how to prove it, days and hours, exclusions). Do not advertise fake reference prices or discounts that are not available.
Respect the law on alcohol and tobacco advertising, food information and consumer protection. No offers for alcohol or tobacco aimed at minors.
Group offers must use the groups provided by Echivo and must not discriminate on grounds prohibited by law.
Checking eligibility: your staff may only look at a customer’s student, service, professional or identity card at the counter. Do not copy, photograph, scan or keep ID data and never ask for the national ID number (CNP). Echivo does not verify these groups for you.
Upload only photos you have the right to use. Avoid identifiable people in photos unless they agreed.
You grant Echivo a free, non-exclusive licence to display, adapt (crop, resize, translate) and distribute your content in the app, on echivo.com and in Echivo promotional materials for as long as the content is listed, and for a reasonable period after removal for already-produced materials.
We may review, edit for format, refuse or remove content that breaks these terms.
7. Honouring offers
The contract for food, drinks or services is between your business and the customer. Offers must be genuine. Your business is responsible for honouring every active offer to customers who meet its conditions, as published at the time of the visit, without extra conditions that are not published. If you need to stop an offer, pause it in the dashboard first. You handle customer complaints about your venue; Echivo may forward them to you. Repeated reports that offers are not honoured may lead to their removal.
8. Featured placement
On plans that include it, your venue may be mentioned near monuments: on the map, briefly at the end of audio guides and by Echo. Every such mention is advertising. You agree that it is always labelled “Sponsored” (RO “Sponsorizat”, HU “Szponzorált”) in voice and text, with your venue named as an “Echivo partner”; this also applies during a free trial. Echivo decides the wording and frequency (one short mention at most, rotated among partners nearby); it never changes historical facts. Echivo may refuse or withdraw a mention at any time. We do not guarantee a number of mentions.
9. Statistics and data
Statistics are aggregated estimates (views, redemptions, taps, mentions) and do not identify individual app users. You must not try to identify app users or use Echivo data for unsolicited marketing. Echivo is an independent controller for your team members’ dashboard accounts and processes them as described in the privacy notice; please make sure the people you add know about it.
10. Accounts and security
Dashboard access uses one-time codes sent to the email address of each team member. Keep access to these mailboxes secure, add only people who work for your business and remove them when they leave. You are responsible for actions taken from your team’s accounts.
11. Liability
The service is provided “as is” during early access.
Echivo is not liable for indirect damage, lost profit, lost revenue or lost data, nor for disputes between your business and its customers.
Echivo’s total liability per year is limited to the fees you paid for the previous 12 months, or EUR 100 if you only used free plans or the trial.
These limits do not apply to damage caused intentionally or by gross negligence, or where the law does not allow a limitation.
You will indemnify Echivo against third-party claims resulting from your content or your failure to honour offers.
12. Changes, law and disputes
We may change these terms with at least 30 days’ notice by email; if you do not agree you may cancel before the change takes effect. These terms are governed by Romanian law. We will first try to settle any dispute amicably; otherwise the competent courts of Oradea (Bihor county), Romania, have jurisdiction.
